Terms and Conditions
§1. General Provisions
The online store operating at www.botanikastory.pl is run by the company Botanika Ewelina Serwiak-Dzwonkowska, headquartered in Wrocław (ul. Blacharska 8c/2, 53-206 Wrocław), VAT ID: 8942817076, hereinafter referred to as the “Seller” or “Botanika.”

These Terms and Conditions define the rules for using the store, placing orders, concluding sales agreements, delivering products, and handling complaints.
The Client may be a natural person, legal person, or organizational unit with legal capacity.
The Terms and Conditions are available on the store website and can be saved or printed by the Client.
§2. Offer
The store offers:
a) Bouquets of cut flowers made to order with delivery,
b) Flower subscriptions (recurring bouquet deliveries).

Other floristry services (e.g., wedding bouquets, funeral arrangements, decorations) are provided outside the online store, upon individual arrangement.
The store’s offer is valid in Wrocław and surrounding areas.
§3. Nature of Products
Products offered in the store are made to the individual Client’s order.
Bouquets are unique – their composition, color scheme, and choice of flowers depend on seasonality and availability.
Product images are for reference only and illustrate the style and size of the bouquet.
The Seller guarantees the freshness of flowers and their durability for at least 3–5 days with proper care.
§4. Placing Orders
Orders are placed through the form available on the store website.
To place an order, the Client:
a) selects a product and its variant,
b) provides the required information,
c) accepts the Terms and Conditions and Privacy Policy.

A sales agreement is concluded upon confirmation of order acceptance by the Seller.
Orders may also be placed on behalf of third parties (e.g., as a gift).
§5. Prices and Payment
All prices are in Polish zloty (PLN) and include VAT (gross prices).
Delivery costs depend on the type of order and delivery location:
- Single bouquets: Mon–Sat: 15–30 PLN, Sundays and holidays: 30–50 PLN
- Subscription deliveries: free of charge
Available payment methods:
- Electronic payments (Przelewy24, BLIK)
- Card payment (for subscriptions)
Order processing begins after payment is received.
§6. Delivery
Deliveries are made within Wrocław and surrounding areas.
The Client selects a preferred delivery day and time window.
In case of recipient absence:
- A second delivery attempt is made (may involve an additional fee)
- Contact may be made with the recipient or the person placing the order
At the Client’s request, the bouquet may be left in a designated location; responsibility for the product transfers to the Client upon leaving.
The Seller is not responsible for delays due to circumstances beyond its control (e.g., weather, traffic incidents).
§7. Changes and Order Cancellation
The Client may contact the Seller to change an order (e.g., address or delivery date) if the order has not yet been processed.
Due to the perishable nature of the products, cancellation after processing has begun may be impossible.
§8. Right of Withdrawal
In accordance with Article 38(4) of the Consumer Rights Act, the Client does not have the right to withdraw from the contract for products that are perishable or have a short shelf life, such as cut flowers and compositions made from them.
§9. Quality and Complaints
Flowers are delivered fresh and prepared immediately before delivery.
Due to seasonality:
- Bouquets may differ from reference images
- The style and value of the composition are preserved
Complaints must be submitted within 2 hours of delivery with a photo of the bouquet.
Complaints can be submitted via email: hello@botanikastory.pl
A complaint must include:
- Order number
- Description of the issue
- Photo documentation
In the case of a justified complaint, the Seller may:
- Deliver a new bouquet
- Refund part or all of the cost
§10. Flower Subscriptions
§10a. Delivery Area
Subscription deliveries are made within Wrocław and surrounding areas (subject to individual arrangement).
The Seller reserves the right to refuse delivery outside the standard area.
§10b. Delivery Days and Times
Deliveries are made on selected weekdays:
- Mondays – recommended for business clients
- Thursdays and Fridays – recommended for individual clients
- Other days – upon individual arrangement
The Client selects the delivery day when placing the order; this choice applies for the entire subscription period unless changed under §10e.
Delivery hours: 9:00–14:00 and 17:00–20:00. Exact times are not guaranteed.
The Seller reserves the right to change the delivery day due to unforeseen circumstances (e.g., weather, logistics).
§10c. Frequency and Subscription Options
The Client chooses delivery frequency: weekly or biweekly.
Subscriptions are delivered in packages covering a set number of deliveries (e.g., 6 deliveries).
The Client selects one of the bouquet sizes: Mini, Midi, or Maxi.
Bouquet composition depends on seasonality and flower availability.
Subscriptions may be given as a gift to a third party – the first delivery includes a voucher for subsequent deliveries.
§10d. Delivery Conditions
The Client must provide a correct and complete delivery address.
Presence during delivery is not required.
The bouquet may be:
- Left at the door
- Delivered to reception or security
- Left in another designated location
For contactless delivery, responsibility passes to the Client when the bouquet is left.
§10e. Delivery Changes and Management
The Client may request changes to the delivery schedule.
Within a 6-delivery package, a maximum of 2 date changes are allowed.
Changes must be requested at least 48 hours before the planned delivery.
Changes may include rescheduling, changing the delivery day, or changing the delivery address.
§10f. Delivery Fees
Subscription deliveries are free – the Client pays only for the bouquet.
Additional fees may apply for:
- Changes exceeding the limit
- Redelivery attempts
- Deliveries outside the standard area
§10g. Liability
The Seller is not responsible for:
- Incorrectly provided addresses
- Delivery impossibility caused by the Client
- Force majeure events
For contactless deliveries, liability passes to the Client.
The Seller’s liability is limited to the value of the order.
§11. Single Bouquet Deliveries
§11a. Delivery Area
Deliveries are made within Wrocław and surrounding areas (subject to individual arrangement).
The Seller reserves the right to refuse delivery outside the standard area, on Sundays, holidays, and during vacation periods.
§11b. Orders
Bouquets may be ordered:
- For oneself
- As a gift for third parties
For third-party orders, the Client must provide correct recipient details, including phone number if required for delivery.
The Seller is not responsible for incorrect recipient details.
§11c. Delivery Days and Times
Deliveries are made Monday–Saturday; Sundays and holidays upon prior arrangement.
Delivery hours: 9:00–11:00, 11:00–14:00, 17:00–20:00. Exact times are not guaranteed.
The Seller reserves the right to change the delivery time due to unforeseen circumstances (weather, logistics).
§11d. Delivery Cost
Single bouquet delivery is a paid service; the cost is included in the bouquet price.
Delivery cost: Mon–Sat: 15–30 PLN, Sundays and holidays: 30–50 PLN, depending on location.
§11e. Delivery Conditions
The Client must provide a correct address.
Presence is not required.
The bouquet may be: left at the door, delivered to reception/security, or left in another designated location.
For contactless delivery, responsibility passes to the Client when the bouquet is left.
§11f. Delivery to a Third Party
In case of recipient absence, the Seller will attempt to contact and may attempt redelivery.
Redelivery may incur an additional fee: Mon–Sat: 15–30 PLN, Sundays and holidays: 30–50 PLN.
If the recipient refuses the bouquet, the order is considered fulfilled; no refund is provided.
At the Client’s request, the bouquet may be redirected to another address or recipient after prior arrangement and additional delivery fee.
§11g. Changes to Orders
The Client may request changes to the delivery address, date, or details.
Ability to change depends on the order processing stage.
The Seller may refuse late change requests.
§12. Personal Data
Clients’ personal data is processed in accordance with applicable laws and the Privacy Policy available on the store website.
§13. Changes to Terms
The Seller reserves the right to amend these Terms.
For orders placed before the amendment, the version effective at the time of the order applies.
For subscriptions, the Client will be informed of changes and may accept them or terminate the agreement.
§14. Final Provisions
Matters not covered in these Terms are governed by Polish law, in particular:
- Civil Code
- Consumer Rights Act
- Act on Providing Services by Electronic Means
These Terms enter into force on the date of their publication on the store website.
